The first petitioner is a society registered under the provisions of the Kerala Co-operative Societies Act. The 2nd petitioner is the Disciplinary Authority. The sole respondent was an employee of the first petitioner society, employed as an attender since 20/10/2013. On the basis of certain allegations leveled against him, after giving her an opportunity of being replied,memo of charges were framed and an enquiry was ordered. Pending the enquiry,respondent moved the Co-operative Arbitration Court , Thiruvananthapauram, by filing Ext.P1 ARC No.62/2020. Disciplinary proceedings was challenged on an initial premise that she was served with two separate memo of charges one dated 2/6/2020 by the sub committee and another dated 4/8/2021 by the president of the society. Contending that the enquiry was based on two separate charge memos, which is illegal, respondent sought to set aside the entire proceedings. Along with ARC, I A No. 1/2020 was filed to stay the disciplinary proceedings on the basis on the charge sheet dated 4/8/2020. The arbitration court granted an interim order against the first petitioner from proceeding with the enquiry. That order is produced as Ext.P3.
