These are applications filed under Section 438 of Criminal Procedure Code by the same person. B.A.No.3178 of 2021 has filed in his capacity as the second accused in Crime No.178/2021 of Pathanapuram Police Station, which was registered alleging offence punishable under Section 3 read with 25(1) (B) (a) of the Arms Act, 1959 and Section 5(1) of the Explosive Substances Act,1908.

The genesis of the crime was the registration of an occurrence report in Punnala Forest Range. The accused Nos.1 to 3 had committed some forest offences and also offence under the Wild Life Protection Act, when they were arrested, it came out that the arms were supplied to the perpetrators of the forest offence by the petitioner and on that basis, he was arrayed as the fourth accused in the occurrence report as well as in the crime. The arms as well as the explosive substances have already been recovered and the learned Public Prosecutor has no objection in in granting him bail.

B.A.No.3336 of 2021 is in his capacity as the accused in Crime No.162/2021, after seizing the arms and ammunitions from his residence falling in Kodumon Police Station. Here also the items have already been recovered on search from his house and therefore, his custodial interrogation is not warranted.

Both the petitions can be allowed on condition that the petitioner shall execute separate bonds for Rs.50,000/- (Rupees Fifty thousand only) in each crime with two solvent sureties each for the like sum to the satisfaction of the respective Investigating Officers; he shall cooperate with the investigation; shall not try to contact or influence the witness or tamper with the evidence and shall not involve in any crime during the period on bail.
