Petitioner is the third accused in Crime No. 4/2021 of Mannamangalam Forest Station, Thrissur. The allegations against the petitioner and others are under Sections 27(1)(e)(iii) (iv) and 52(1) of the Kerala Forest Act. According to the learned counsel for the petitioner, even though the allegation is that the accused Nos. 1 and 2 had cut and felled Dysoxylum Malabaricum (Vella Akil) from the forest and transported 150 kgms of wood and sold to the fourth accused, nothing has been seized from him and he has no connection whatsoever with the contraband.

The learned Public Prosecutor has submitted that

Vella Akil was cut and removed by the accused Nos. 1 and 2, transported in the vehicle of the third accused and handed over to the fourth accused and the petitioner/third accused was acting as the active agent of the fourth accused.

The learned counsel for the petitioner submits that he is prepared to co-operate with the investigation.

The specific allegation is that the petitioner has transported trees, which is forest produce in the vehicle owned

by him. Therefore, in the event of himself surrendering and also producing the vehicle within ten days from today, he shall be released on bail on executing bond for Rs.50,000/-(Rupees Fifty Thousand Only) with two solvent sureties each for the like sum to the satisfaction of the Investigating Officer; he shall cooperate with the investigation; shall not try to contact or influence the witnesses or tamper with the evidence and shall not involve in any crime during the period on bail.
