The petitioners are land allottees running industrial units in the Industrial Estate, Olavakkode, Palakkad. They are before this Court seeking to issue a writ of Mandamus directing the 2^nd respondent-Kerala Small Industries Development Corporation Ltd. (SIDCO) to execute Sale Deeds in favour of the petitioners.

When this writ petition came up for hearing today, the learned Standing Counsel appearing for the 2^nd respondent-SIDCO submitted that in the case of the 1^st petitioner, the Industrial Unit was allotted to one Mr. K.T. Baby. The said K.T. Baby requested for change in the constitution of the Unit from proprietorship to partnership, proposing the 1^st petitioner as one partner. The allottee has not submitted necessary documents for change of

constitution and the Unit still remains as a proprietary concern of Mr. K.T. Baby.

In the circumstances stated above, no relief can be granted to the 1^st petitioner, in this writ petition.

As regards petitioners 2 to 10, the Standing

Counsel for the 2^nd respondent would submit that the matter is under process.

¶39

The writ petition is therefore disposed of directing the 2^nd respondent to submit applications for NOC from the District Collector for execution of sale deeds, expeditiously. The 2^nd respondent shall execute sale deeds as and when NOCs are received, without further delay.
