ORDER

Petitioner stands arrayed as the first accused in Crime No.1505 of 2018 of Medical College Police Station for offences punishable under sections 294(b), 324, 326 and 308 r/w 34 of the Indian Penal Code.

The allegation of the prosecution is that, due to previous enmity on 10.10.2018 at 1 a.m., petitioner herein trespassed into a house where the defacto complainant was staying during night and brought him out. Thereafter, defacto complainant was hit with cricket bat. He sustained injuries on the various parts of the body and was taken to the Medical College Hospital. Crime was registered and investigation is progressing. Apprehending arrest, petitioner seeks bail.

Though the learned counsel for the petitioner contends that the defacto complainant was not residing in the house where allegedly the incident took place and he is not a resident of the locality, there are materials to show that the defacto complainant had sustained fractures. It is also seen that, even in the FIS, the name of both accused have been referred to. Petitioner has no criminal antecedents. Hence, I am inclined to direct the petitioner herein to surrender before the investigating officer within 10 days from today. After interrogation and identification, he shall be produced before the jurisdictional court on the same day itself,
