It was also alleged that, officials of the customs authority threatened and forced the officers of the petitioners company to give false statement against the company. It was also alleged that, the then Commissioner of Customs, Kochi, had special interest in damaging the business of the petitioners' company. It was alleged that, under his direction, one Vivek, Superintendent of Customs(Preventive) took one Madan, who was the main employee of the petitioners' company, into custody and was assaulted in the course of questioning. He sustained serious injuries. It was reported to the police which registered Crime No.2248/2017 of Valliyathura police station for various offences including sections 323 and 324 IPC against the various authorities of the customs. It was stated that, CISF in the Airport had also supported the allegation of assaulting Madan by Vivek. It was alleged by the customs authority that malpractice to the tune of Rs. 6 Crores was detected. According to the petitioners, since only 65 bottles were short, the difference was only 1.25 lakhs or less, which was blown beyond proportion into a huge malpractice. Petitioners contended that the statements of all the officers of the petitioners' company have been recorded and the CEO was also arrested. According to the petitioners, custodial interrogation of the petitioners herein is not required and they sought bail.
