J U D G M E N T

This case has been filed alleging non compliance of the order of this Court in W.P.(C).No.42161 of 2017 at the hands of the respondent who is the present Revenue Divisional Officer, Kochi.

In the judgment in question, I had directed the said

officer to take up and consider Ext.P1 application of the petitioner, after issuing proper notice to him as also to respondents 3 to 5 and after affording an opportunity of being heard, in terms of law within a period of three weeks from the date of receipt of a copy of that judgment. Petitioner says that no orders have been issued and thus alleges that the respondent is acting contemptuous to the authority of this Court.

Even though this matter was called more than two times today, there was no representation for the petitioner. However, the learned Government Pleader, on instructions, submits that the RDO has already heard the petitioner and respondents 3 to 5 on 28.02.2018 and submits that an appropriate order will be issued by the said authority on or

before 16.03.2018. She apologized for the delay and prays that this contempt of court case may be closed.

Taking into account of the unequivocal submission made by the learned Government Pleader, I deem it appropriate to close this contempt of court case, reserving liberty to the petitioner to seek re-hearing, if no orders are passed by the respondent on or before 16.03.2018, as undertaken by the learned Government Pleader.
