ORDER

Petitioner herein stands arrayed as the eighth accused in Crime

No.515 of 2018 of Adoor Police Station for offences punishable under sections 143, 144, 147, 148, 294(b), 506, 323, 324, 427, 307, 149 of the Indian Penal Code.

According to the prosecution, on 20.02.2018 at 7.15 p.m., accused formed into an unlawful assembly and in prosecution of their common object, wrongfully restrained the first informant and his friend and inflicted injuries on them using weapons. Crime was registered and the petitioner herein, apprehending arrest, seeks bail.

It seems that, some of the accused were granted bail by order in Annexures-2 and 3. According to the prosecution, main overt act is attributed to accused Nos.1 to 3. Considering the lesser degree of culpability alleged against the petitioner herein, I am inclined to grant prearrest bail to the petitioner herein subject to the following conditions.

(i) Petitioner shall appear before the investigation officer within ten days from today and shall undergo interrogation. Thereafter, if he is proposed to be arrested, he shall be released on bail on executing a bond for a sum of Rs.40,000/- (Rupees forty thousand only) with two sureties for the like sum each.

(ii) He shall appear before the investigating officer as and when called for.
