The petitioner herein is arrayed as the 3^rd accused in crime No.1005/2018 of Kunnikode Police Station for offences punishable under Section 294(b), 341, 323, 324, 326 and 427 read with Section 34 of IPC. The allegation of the prosecution is that the petitioner herein along with other two accused attacked the de facto complainant and inflicted injuries on him. The petitioner seeks bail apprehending arrest. It seems that the 1^st accused hit the de facto complainant with a jacky lever. The 2^nd accused attacked him using a wooden log. The 3^rd accused hit on the face of the de facto complainant with a piece of stone. It seems that the de facto complainant sustained serious injury on his forehead, which was inflicted by the 2^nd accused.

Considering the fact that, there is no serious allegation against the petitioner herein and that he is not involved in any other crime and the existence of a counter claim as crime No.1104/2018, I am inclined to grant bail to the petitioner herein on the following conditions:

(i) Petitioner shall appear before the investigation officer within ten days from today and shall

undergo interrogation. Thereafter, if he is proposed to be arrested, he shall be released on bail on executing a bond for a sum of Rs.40,000/(Rupees forty thousand only) each with two sureties for the like sum each.

(ii) He shall appear before the investigating officer on all Wednesdays between 9 am and 10 am for the period of two months, from the date of execution of the bond.

(iii) He shall not threaten, coerce or intimidate the defacto complainant and the witnesses nor shall he interfere in the process of investigation.

(iv) He shall not get involved in any other crime.

¶25

Anticipatory bail application is allowed as above.
