O R D E R

Petitioner herein is the first accused in Crime No.884/2018 of Oachira Police Station for offences punishable under sections 447,294(b), 323,324,308 read with section 34 IPC.

Allegation of the prosecution is that, pursuant to a family dispute, the petitioner, along with other accused, inflicted injuries on the defacto complainant and the others on 24/8/2018 a 7.45 a.m. The incident took place at the courtyard of the wife house of the defacto complainant. There was an allegation that, petitioner used to chase the sister of the wife of the defacto complainant and make uninvited comments. It is stated that, petitioner and the other accused attacked the defacto complainant who sustained three injuries on the scalp and the other parts of the body. Investigating is progressing.

Specific overtacts are attributed to the petitioner herein. However, it is pertinent to note that he has no criminal antecedents. The disputes seems to have arisen out of the family dispute. Having considered these facts, especially in the absence of any criminal antecedent, I am inclined to direct the petitioner herein to surrender before the investigating officer within ten days from today, If he so surrenders, after interrogation, identification and recovery of the weapon used, he shall be produced before the Jurisdictional Magistrate
