ORDER

Petitioner herein stands indicted as the first accused in Crime No.7 of 2018 of Karippur Police Station for offences punishable under 143, 147, 148, 294(b) r/w 149 of the Indian Penal Code and section 3(1) of the PDPP Act and 118(a) of the Kerala Police Act.

It is alleged by the prosecution that, on 24.01.2018 at 20.15 hrs, at the leadership of the petitioner herein, certain persons consumed alcohol and created nuisance to the public. Police was informed who reached the spot. About 20 persons under the leadership of the petitioner herein obstructed the police and caused damage to the police jeep. 4 persons were arrested from the spot. Apprehending arrest, petitioner seeks bail. It was submitted that loss caused to the vehicle was quantified at Rs.10,000/-.

It seems that the entire incident happened in front of the house of the petitioner herein. He was the leader of the group, it is alleged. Few other accused were granted bail by the order of this Court in B.A.No.2757 of 2018. Considering the fact that the petitioner herein also stands on the equal footing, though, stated to be the leader of the gang, I am inclined to take a lenient view and to grant bail to the petitioner herein.

(i) Petitioner shall appear before the investigation officer within ten days from today and shall undergo interrogation. Thereafter, if he is proposed to be arrested, he shall be released on bail on executing a bond for a sum of Rs.40,000/- (Rupees forty thousand only) with two sureties

for the like sum each. He shall deposit a sum of Rs.2,000/(Rupees two thousand only) before the trial court within 15 working days from the date of execution of the bond.

(ii) He shall appear before the investigating officer on all Saturdays between 9 am and 10 am for the period of two months, from the date of execution of the bond.

(iii) He shall not get involved in any other identical
