are the fresh fish vendors and 7th petitioner is dried fish vendor in the old fish market of the Pattambi Municipality. As per the decision taken by the respondent Municipality dated 30/8/2017 decided to conduct auction of stalls of the New Market except the stalls No.s 1, 2, 3, 4, 5, 6, 9, 18, 19, 22, 23, 17, 24. The stalls which are excluded in the auction was reserved for the purpose of rehabilitating the persons who were occupying the rooms in the old market. Accordingly the municipality decided to allot for the successful bidder Stall No.s 7, 8, 16 for selling fresh fish, stall No.s 10, 11, 12 for selling dried fish, stall No.s 20, 21 for mutton stall and stall No.25 for beef stall. Further decided to provide the stall No. 14, 15 for the Scheduled caste and stall No. 13 to the physically challenged person. The entire stalls of first floor are reserved for only for the purpose of Chicken stalls. It is further decided to receive 2 Lakh as deposit for the stall No. 7, 8, 16, 10, 11, 12, 20, 21, 25 and all the stalls in the 1st floor. However, as per the same resolution dated 30/8/2017 it was further resolved by the municipal council, as per Ext.P8 that, in respect of those who were occupying the stalls in the old market, as a concession, they need pay only Rs. 1 Lakh as deposit and need to pay rent fixed as the lowest tender/auction amount for each respective category.
