This appeal is filed by the petitioner in OP No.339/2013 aggrieved by order dated 25/8/2014 by which an application to restore the original petition on file came to be dismissed. The original petition is filed for cancellation of the sale deed in respect of petition schedule property. The petition was dismissed on 11/12/2013 on the failure on the part of the appellant to file the chief examination affidavit.

The appellant submitted application on 18/2/2014 to restore the OP to file. The same came to be dismissed by the impugned order on the ground that there is delay in filing the application. It is observed that no application was filed to condone delay and no explanation is forthcoming for not examining the power of attorney holder who filed the affidavit in support of the application.

Learned counsel for the appellant submitted that as per the proceedings sheet of the Family Court, Tirur, the case was called on 3/12/2013. Thereafter, it was posted on 11/12/2013 for appellant's evidence. Since the appellant was not present, OP was dismissed for non-prosecution.

The respondent objected to the application contending that the application is not legally sustainable and it is barred by limitation. For considering the application, appellant was examined as PW1. He deposed before Court that he came to know about the case only on 3/2/2014 and accordingly an application was filed on 18/2/2014. Hence, according to the appellant, there is no delay in filing the application. It is also indicated that there was another case between the same parties which was posted on 3/2/2014 in which the appellant appeared. Only on that day, he had come to know about the transfer of both the cases. In the appeal, learned counsel for the appellant submits that the Court below ought to have allowed the application.

ought to have known about the transfer of the two cases which were pending between the parties and both the cases were transferred on the same day and when the appellant had appeared in one case, it is totally unbelievable that the appellant did not know about the pendency of the other case. That apart, unnecessarily, the respondent is being harassed by filing case after case. Appellant is not interested in the proceedings and is only delaying the matter.

Having heard the learned counsel on either side and having perused the records, we are of the view that there is considerable force in the contention of the appellant that they were not aware of the proceedings. Apparently, they had appeared in one of the cases which was transferred to the Family Court, Tirur on 3/2/2014. If the appellant was aware of the posting date in the present case, definitely, there was no reason why the appellant would not have appeared on the said date. This aspect of the matter by itself was enough to restore the original petition to file. However, the Family Court proceeded on the basis that there is delay in filing the application. According to the appellant, there was no delay as the appellant was not aware

of the posting before the Family Court. It is not clear from the impugned order that after the case was transferred, notices were issued to the parties to the lis . Under such circumstances, the Family Court ought to have granted an opportunity atleast to the appellant to file application to condone delay and thereafter restore the original petition to file. If at all there was any laches, it ought to have been compensated in terms of costs.

In the result, we are of the view that an opportunity should be granted to the appellant to prosecute the matter and accordingly, this appeal is disposed of as under:-

(i) The impugned order dated 25/8/2014 in IA No.245/14 in OP No.339/2013 is set aside.

(ii) Taking into account the factual circumstances involved in the matter, we are of the view that delay of 38 days can be condoned on terms. That the delay in filing IA No.245/14 is hereby condoned on condition of the appellant paying a cost of `3,000/- (Rupees Three thousand only) to the counsel appearing for the respondent within a period of two weeks from today. Appellant shall produce a memo of cost before the Family Court within one week thereafter.

(iii) On payment of cost, IA No.245/2014 shall stand allowed and OP No.339/2013 shall be restored to file and the Family Court, Tirur shall consider the matter and dispose of the same in accordance with law.
