On 01.04.2000, the first respondent herein filed Ext.P5 application as the I.A.1727/2000 for measuring the property on the basis of his title deed and the first respondent was examined as DW1 in that application. After considering Ext.P5 application was allowed by the court below and it was remitted to the commissioner for submitting a fresh plan and report by measuring the defendants property also as per Ext.P6 order. Since Adv. Raphy Thomas did not comply with the direction of the court, his warrant was recalled and later Adv. Beena Menon was appointed as commissioner. She also expressed her inability to execute the warrant. Thereafter Adv. N.D. Joy was appointed as commissioner and he had submitted Ext.P7 plan and report. Petitioners filed serious objections and also filed I.A.7094/2006 for remitting the commissioners report, but that was dismissed by the court below by Ext.P8 order dated 17.01.2007. Though petitioner No.1 filed W.P.(C)4220/2007 before this court challenging Ext.P8 order, that was dismissed. 2nd petitioner also filed W.P.(C)19031/2007, challenging the same order, that was also dismissed by this court as per order dated 18.01.2011.
