O R D E R

Petitioner is the accused in L.P.No. 14/2003 on the file of the Additional Chief Judicial Magistrate Court, Ernakulam. The offences alleged against the petitioner are punishable under Sections 465, 466, 468, 420 r/w 34 of IPC. Due to the nonappearance of the petitioner, non-bailable warrant has been issued against him The Crl.M.C is filed seeking a direction to the Additional Chief Judicial Magistrate Court to consider his bail application on the date of surrender itself.

The petitioner is willing to surrender before the trial court. Warrant is pending against him. Now, the petitioner seeks a direction from this Court to consider his application for bail on the date of surrender itself.

Accordingly, the Crl.M.C is disposed of directing the Additional Chief Judicial Magistrate Court, Ernakulam to consider and pass appropriate orders on the bail application, if any, filed by the petitioner on the date of surrender itself with prior notice to the Assistant Public Prosecutor, in the event of the petitioner surrendering before the court below within a period of fifteen days from today. The warrant issued against the petitioner shall be kept in abeyance till the disposal of the bail application.
