O R D E R

Petitioner is the sole accused in Crime No. 529/13 of Pazhayangadi Police Station pending on the file of the Judicial First class Magistrate Court, Payyannur. Petitioner obtained bail in B.A. No. 6758/2013. It is submitted that one of the conditions for the bail is that the petitioner shall surrender his passport. Petitioner surrendered his passport. The petitioner filed CMP No. 6835/2013 seeking to release his passport. The same was dismissed by the learned Magistrate vide order dated 2.1.2014. Copy marked for reference as Annexure A1.

It is submitted that the petitioner is doing business in Gulf and he is meeting is livelihood from the said business. It is pointed out that the investigation of the case is over and the police filed Final Report before the Court. It is also submitted that petitioner is willing to appear before the court as and when required. It may take few years for completing the trial.

Having regard to the facts and circumstance, this Court is inclined to grant any relief sought for in CMP No.6835/2013. The
