Heard the learned counsel for the petitioner and respondent.

Petitioner is the 4^th accused in C.C.No. 262/2007 pending

on the file of the Judicial First Class Magistrate Court II, Ernakulam. The petitioner is charge sheeted for the offences punishable under Sections 143, 147, 148, 323, 326 r/w Section 149 of the IPC. Petitioner appeared before the court and took bail. Petitioner went abroad in connection with his employment and therefore, he was unable to appear before the court on subsequent postings. Due to the non-appearance of the petitioner, warrant was issued against him.

The petitioner is willing to surrender before the court below. Warrant is pending against him. Now, the petitioner seeks a direction from this Court to consider his application for bail on the date of surrender itself.

In the facts and circumstances, the Crl.M.C is disposed of, directing the Judicial First Class Magistrate Court II, Ernakulam to consider and pass orders on the bail application on the date of surrender itself in the event of the petitioner surrendering before the

court below and submitting an application for bail with prior notice to the Assistant Public Prosecutor within a period of three weeks from today. The warrant issued shall be kept in abeyance till the bail application is heard and dispose of.
