This is a suo motu proceedings based on the report of the learned Ombudsman in CDB Report No.45 of 2013 in Complaint No.128 of 2012. The complaint is in respect of the construction of protection wall to the Temple well in Kurukulam Kottaram. The complainant is one K.Narayanan Kutty.

The Learned Ombudsman has pointed out that the matter is pending consideration before the Inam Settlement Officer as remanded by the District Collector. It relates to the claim of Sri.Mani that the property is Inam Settlement and till then the order of the Special Tahsildar is stayed. Even though it has been pending for long time, the Inam Settlement Officer has not passed any orders. Therefore, the Learned Ombudsman has requested this Court to direct the Inam Settlement Officer to pass final orders on the complaint, within in a reasonable time.

We heard the learned Standing Counsel for the Board and the learned Amicus Curiae appearing for the Learned Ombudsman.

The Inam settlement Officer is the 3^rd respondent herein. In the

light of the order proposed to be passed, it is not necessary to issue notice to the 3^rd respondent. Hence, we direct the Inam Settlement Officer, Trichur to pass appropriate orders in the matter, within a period of three months from today after hearing the necessary parties. Registry will communicate a copy of Report No.45 of 2013 along with a copy of this

order to the 3^rd respondent for compliance.
