The matter relates to the special audit report of the accounts of Chenthitta Devaswom in Thiruvananthapuram Group for the period from 01.04.2011 to 31.12.2012. This Court, by order dated 24.06.2013, referred the matter for consideration of the learned Ombudsman, who filed report No.120/2013. After hearing parties, the learned Ombudsman, in paragraph 2 of the report, has suggested that paragraphs 2 to 15 of the audit report can be considered for closure. We accept the same and accordingly we close the same. As regards paragraph 16 also, it has been submitted that in the light of the agreement, the

Bharanipathram Register can be verified in the subsequent audit after the Register is updated. The said paragraph is closed. As regards paragraph 17 also, we accept the suggestion that the said paragraph can be closed in the light of the facts revealed during the hearing. We also record the suggestion that as far as remaining officers are concerned, their liabilities can be adjusted at the time of their retirement, if not cleared earlier.

Lastly, the learned Ombudsman has stated that a time bound direction will have to be given for completion of the disciplinary proceedings in respect of Sri.M.V.Gopakumar. It is submitted by the learned Standing Counsel for the Board that the same will be completed expeditiously. We direct the Board to complete the disciplinary proceedings in respect of Sri.M.V.Gopakumar within ten months from today.

With regard to the suggestion of the Local Fund Audit

to involve the Vigilance Department for enquiring into various aspects, it is submitted by the learned Standing Counsel that even now the recommendation for conducting vigilance

investigation in respect of matters of 2005 are still pending without completion. We leave it to the Board to take an

appropriate decision.
