JUDGMENT

The petitioner is seeking for a direction to the respondents 1 and 2 to initiate action under the Kerala Police Act against the 3^rd respondent.

The petitioner points out that the 3^rd respondent is employed in the Police Department as Assistant Sub Inspector, Special Branch, Kollam. Section 86(e) of the Kerala Police Act deals with the disqualification for appointment as police officer or right of police officer to continue in employment as police officer if that person is an office bearer of any social, religious, cultural or scientific organisation. The 3^rd respondent became an elected member of the Trust, namely, Mulankadakam Devi Temple Trust. The election was conducted on 27/12/2011.

The learned counsel for the petitioner submitted that the third respondent has already resigned from the membership of the Committee of the Temple Trust. In that view of the matter, the Writ Petition is closed recording the same.
