consideration of Rs.5,21,000/-, she spent some money for reimbursement of the land mutation expenses, settlement of her debts, etc. and the remaining sum of Rs.4,32,000/- was deposited in the Angadi Service Co-operative Bank Ltd. No.2770 in SB Account No.6570 opened in the joint names of the third respondent and Smt. Joyice. The said deposit was made on 26.12.2011. It is also averred that the late mother has decided to purchase a property having an extent of 27 cents in R.S. No.119/2010 in Block No.8 of Angadi Village from one Mr. T.P. Chacko. However, the agreement could not be executed during her life time and Ext.R3 is the copy of the agreement executed by Shri T.P. Chacko in favour of Smt. Joyice and the sale consideration is stated to be Rs.40,000/- per cent. The advance amount of Rs.3,05,000/- was withdrawn from the joint account. It is also stated that another sum of Rs.30,000/- was withdrawn for meeting the funeral expenses of later mother and Rs.7,000/- has been withdrawn for the purpose of expenses of this litigation.
