JUDGMENT

The writ petition is filed seeking a direction directing the respondents not to insist the petitioner to produce road fitness certificate to operate his stage carriage bearing Reg.No.Kl-07AE 2478 to operate on the route Kazhimbram-Kanjani, Muttichur Bridge, Muttichur and Antikkad and for other incidental reliefs.

Petitioner applied for regular permit to operate on the route Kazhimbram-Kanjani. Regular permit has been granted and timings of the stage carriage was also fixed. But fiirst respondent insisted production of road fitness certificate. It is submitted that construction of Muttichur Bridge was completed months back and now another stage carriage vehicle KL-02M 8919 is operating on the said route has already produced road fitness certificate and he is operating his stage carriage. Therefore, it is submitted that there is no necessity to produce road fitness certificate again to operate on the same route.

Learned Government Pleader on instructions submits that petitioner has already submitted road fitness certificate,

The writ petition is disposed of directing the 2^nd respondent to issue permit to the petitioner for his stage carriage KL-07 AE 2478 on the basis of Exts.P1 and P2 within a period of one month.
