J U D G M E N T

The writ petition is filed seeking a direction directing respondents 1 & 2 to correct the mistake with respect to registration number and toddy shop number in the identity card of the petitioner and to issue a fresh identity card.

The petitioner is an employee in toddy shop No.39 (Thekkemuri in East Kallada Panchayath) in Kollam Excise Division. The petitioner applied for a new identity card and the 2^nd respondent issued the card. It is submitted that the registration number and place of work (toddy shop number) were wrongly stated. Therefore, the petitioner approached the respondents to correct the mistake. The correction has not so far been carried out. Ext.P1 is the copy of the identity card issued by the 2^nd respondent. Ext.P2 is the copy of the newly issued registration/identity card with photograph of the employee.

It is submitted that the petitioner is still working in toddy shop No.39/11-12 (Thekkemuri). It is pointed out that toddy shop No.41 - Cheekal Kadavu stated in Ext.P2 new identity card is a different toddy shop. Information received from the

excise division, Kollam, is marked as Ext.P3. The petitioner came to know that the toddy shop at Cheekal Kadavu was not auctioned this year and its number is also different and that toddy shop No.41 as shown in Ext.P2 identity card is at Mulavana near Kundara. Information furnished from the office of the excise inspector dated 10.11.2011 is marked as Ext.P4. In the circumstance, it is highly necessary to rectify the wrong entry made in the identity card of the petitioner and to issue a new identity card. Ext.P6 is the copy of the representation dated 9.11.2012 submitted by the petitioner before the 2^nd respondent.

In the facts and circumstances, the writ petition is disposed of directing the 2^nd respondent to consider and pass appropriate orders on Ext.P6 representation, within a period of one month from the date of receipt of a copy of this judgment, after affording an opportunity of being heard to the petitioner.
