JUDGMENT

The petitioner is aggrieved by the delay in considering the application Exhibit P4 by the respondent, in spite of the direction issued by this Court in Exhibit P3 judgment. The matter concerns the consideration of the application submitted by the petitioner to

grant permission for reclamation of the land under the Kerala Land Utilisation Order.

A reading of Exhibit P3 shows that the direction therein was to the respondents to consider and pass orders within a period of six weeks from the date of receipt of the application. It appears that the hearing was already conducted; but no orders have been passed.

The learned Government Pleader on getting instructions submitted that the then Revenue Divisional Officer has been transferred and a new Officer has taken charge. Therefore, if orders have not been passed by the then Revenue Divisional Officer, the successor in Office, namely the present

Revenue Divisional Officer will take a decision in the matter, after hearing the petitioner, within a period of one month from the date of receipt of a copy of this judgment. If already orders have been passed by the then Revenue Divisional Officer, then the copy of the order will be communicated to the petitioner.
