This contempt matter has been filed alleging non compliance of the direction given by this Court as per Annexure A3 judgment dated 28.9.2012 in W.P.(C).No.21714 of 2012. It

has been conceded by the petitioner that, pursuant to the direction given by this Court, Annexure A5 order came to be passed on 4.10.2012, with regard to the regularisation of period of suspension for the period from 4.4.2012 to 6.6.2012. But the grievance of the petitioner with regard to have a posting at Chalakkudy and the issuance of the payslip which also were highlighted in the representation (which was directed to be considered as per the Annexure 3 judgment) has not been dealt with in Annexure A5, which is stated as an act amount to offence punishable under the relevant provisions of Contempt of Courts Act.

When the matter is taken up for consideration today, learned counsel appearing for the respondents submits with

regard to the posting of petitioner in Chalakkudy, the same had to be separately dealt with and another order has already been passed on 27.10.2012, a copy of the order is also made available for the perusal of the learned counsel for the petitioner.

In the above circumstance, this Court does not find it as a fit case to proceed with any further steps in respect of the alleged offence of contempt. The contempt matter is closed, without prejudice to the rights and liberties of the petitioner with regard to any subsisting grievance, by way of other appropriate proceedings.
