J U D G M E N T

The petitioner has approached this Court with the following prayers:

“a) to issue a writ of mandamus or any other appropriate writ, order or direction directing the 2^nd respondents to order for a detailed enquiry based on Exhibit P5 as regards the offences suspected to have committed by the 6^th respondent with the connivance of the postmaster of Nellai Post Office, Thrissur district.

b) to issue a writ of mandamus or any other appropriate writ, order or direction directing the 2^nd respondent to consider and pass orders on Exhibit P5 on a time bound basis

e) granting such other relief or reliefs as are prayed for by the petitioner in the course of this Original Petition or which are deemed fit by this Honourable Court.”

The learned Counsel for the petitioner submits that the

course and conduct of the concerned agent and the officers who

are at the helm of the affairs of the department is liable to be deprecated since the amount deposited by the petitioner in the Saving Bank account was caused to be temporarily misappropriated sustaining loss to the petitioner ( by way of loss of interest) and that the complaint preferred by the petitioner is still to be enquired into. Hence the writ petition.

The learned Asst. Solicitor General appearing for the respondents submits that the petitioner has admittedly preferred Ext. P5 before the second respondent and that the same will be duly enquired into.

In the above circumstance, the writ petition is disposed of, directing the second respondent to consider Ext. P5 and take appropriate steps in accordance with the relevant provisions of law, as expeditiously as possible.
