JUDGMENT

The issue involved in this case is whether the respondent Bank, which is public sector Bank, is justified in driving the petitioners to the nearest branch for obtaining 'educational loan', as sought for, in connection with the higher studies of the first petitioner.

Whether the prospective aspirants like the petitioner are bound to go by such stipulations or directions and whether the public sector bank, like the respondent Bank can drive them away as above, referring to some circulars of minutes issued by the State Level Bankers' Convention or such other instructions as pleaded in the statement dated 11.05.2011 by the respondent, had come up for consideration of this Court earlier in W.P.(C) 21485 of 2009. The issue was dealt with in detail and the Writ Petition was allowed, as per the judgment dated 12.04.2011, deprecating the stand taken by the Bank (State Bank of India in the said case) and making it clear that no such course was ever possible, simultaneously giving positive directions to consider the application for loan on merits and to extend the benefits to

the extent as provided in terms with the norms, if any, issued by the Reserve Bank of India.

The issue involved in this case is squarely covered by the said verdict. Accordingly, this writ petition is also allowed, directing the respondents to consider the application and the documents preferred by the petitioner (which are presumably at the hands of the Bank and are still to be returned to the petitioner, as discernible from Ext. P6) and finalize the matter as expeditiously as possible, at any rate, within one month from the date of receipt of a copy of this judgment.

Petitioner shall produce a copy of this judgment along with copy of the writ petition and judgment in W.P.(C) No. 21485 of 2009 before the concerned respondent for further steps.
