JUDGMENT

The petitioner is a stage carriage operator. He has been granted a regular permit as per proceedings dated 22.7.2009. He conducts services on the route Kootayi AzhimughamParappanangadi, Purathur (via) Arikkanchira, Murivazhikkal, Vallikanhiram, Pookayil, Tirur, Vattathani, Tanur, Puthiyakadappuram, Alathiyoor, Pulloonni and Mangalam with stage carriage bearing registration No: KL 07AG 1830. The permit has been granted subject to settlement of timings. Pursuant to the order, Ext.P2 order of settlement of timings was issued. According to the petitioner the timings granted to him as per Ext.P2 have not been issued to him till date. Instead the timings of the petitioner has been settled as per Ext.P8. The timings in Ext.P8 are different from that in Ext.P2. He claims that he is entitled to settlement of his timings in accordance with Ext.P2.

It is submitted by the Government Pleader that the timings in Ext.P2 have been allotted to other operators. It is asserted by the counsel for the petitioner that apart from the departure timing from Tanur-Purathur all other timings in Ext.P2 are available for

allotment to the petitioner. According to the learned Governmnt Pleader, if the timings are available, he has no objection to the same being allotted to the petitioner.

In view of the above submission, this writ petition is disposed of directing the second respondent to settle the timings of the petitioner by allotting the time slots in Ext.P2 that are still available. The timings in Ext.P8 shall be modified to the said extent. Orders in this regard shall be passed as expeditiously as possible and at any rate within a period of one month from the date of receipt of a copy of this judgment.
