The petitioner owned 1 Acre and 3 cents of land comprised in Re-Sy.No.632/14 of Eravipuram Village, Kollam Taluk, Kollam District. The said parcel of land was acquired at a point of time when the petitioner was employed abroad. Though he challenged the acquisition through his wife by filing W.P.(C) No.27667 of 2008, it was dismissed by a Division Bench of this Court, as evidenced by Ext.P1. The Special Leave Petition filed before the Apex Court was also dismissed as per Ext.P2 order. Later, an award was passed on 5.2.2009. It is stated that the award was not passed in the presence of the petitioner and he was at that point of time abroad. Long thereafter, the petitioner submitted Ext.P7 representation dated 31.8.2009 to the second respondent requesting him to refer the dispute regarding the quantum of compensation to the Sub Court, Kollam. He had not received the compensation awarded by the Land Acquisition Officer at that point of time and he received the compensation amount later under protest on 6.10.2009. Shortly thereafter, the second respondent informed the petitioner by Ext.P8 memo that his application for reference is belated and therefore is rejected.
