J U D G M E N T

The petitioner retired on 31-03-2010 while working as H.S.A.(Natural Science) in S.N.T.H.S. School, Chelannur. While in service, certain allegations were levelled against the petitioner. Those allegations were enquired into and Ext.P1 report was submitted by the third respondent. Since the report was in favour of the petitioner, the Manager of the School took up the matter before the Government in revision. Ext.P2 is the order passed by the Government in revision. Though the findings in Ext.P2 were to the effect that the allegations raised therein were baseless, the Manager continued with the proceedings and issued Ext.P3 show

cause notice as to why a punishment of barring of three increments without cumulative effect or in the alternative recovery of amount equivalent to the aforesaid punishment should not be imposed on the petitioner. The petitioner has filed his explanation as per Ext.P4. Without properly considering the explanation offered by the petitioner in Ext.P4, the 4^th respondent has passed Ext.P5 order confirming the aforesaid proposed punishment.

Feeling aggrieved by Ext.P5, the petitioner has submitted Ext.P6 revision petition under Rule 92 of Chapter XIV-A of the Kerala Education Rules before the first respondent.

Ext.P6 is now pending before the Government. Therefore, this writ petition is disposed of with a direction to the first respondent to consider and pass orders on Ext.P6, expeditiously, at any rate, within a period of three months from the date of receipt of a copy of this judgment, with notice to the petitioner and the fourth respondent.
