JUDGMENT

The petitioners are residents of Pampadumpara Grama Panchayat in Idukki District. They belong to the category of Below Poverty Line, who are having no residential houses also. Various schemes have been framed to allot houses to the homeless by the Government.

Herein, we are concerned with the scheme framed by the Government, viz. E.M.S. Complete Houses Scheme which is to be implemented during the financial year 2009-2011. What is complained of by the petitioners is the irregular manner in which the list of beneficiaries have been prepared by the Panchayat. Aggrieved by the same, the petitioner has filed a representation before the District Collector as Ext.P3.

The District Collector, according to the scheme, is the fund disbursing authority. Since the matter requires deeper examination by any competent authority, it is up to the petitioner to avail of the alternate remedy by approaching the Ombudsman for Local Self Government Institutions. The said remedy is an effective and adequate one. Therefore,

it is only proper that the petitioner moves the Ombudsman in the matter.

The writ petition is accordingly disposed of. No costs.
