Petitioner calls in question Exts.P3, P4, P5 and P6. I heard the learned counsel for the petitioner and the learned Government Pleader. Apparently, Ext.P3 is a Mahazar and P4 is a provisional bill. Ext.P5 is stated to be a final bill. Ext.P6 is the communication from the Assistant Engineer to the BSNL. Learned standing counsel would submit that Exts.P4 and P5 can be treated as provisional bills and the petitioner will be afforded an opportunity of being heard and a decision will be taken in accordance with law. In the light of this submission, which I record, the Writ Petition is disposed of directing that if the petitioner files objection to Ext.P5 within ten days from today, it will be considered in accordance with law, after affording an opportunity of hearing to the petitioner, within one month from the date of filing the objection. Till such time, there will be no disconnection pursuant to the impugned communication.
