Learned counsel for the petitioner submits that subsequent to the dismissal of the petition to condone delay an order had been passed in the main application moved under Order IX Rule 9 of the Code of Civil Procedure also by the court below, and so much so, the review petition may be closed with liberty to challenge the order passed in the application under Order IX Rule 9 of the Code of Civil Procedure in accordance with law. Reserving the right of the petitioner to take appropriate proceedings as provided by law, the review petition is closed.
