ORDER

Petitioner, who is the 1^st accused in Crime No.193 of 2007 of Pathanapuram Police Station for offences punishable under Sections 449 & 302 IPC, seeks to modify the condition imposed by the J.F.C.M- III, Punalur, in the order dated 31.07.07 granting bail to the petitioner. The impugned condition is that he shall make a deposit of 20,000/- as cash security.

The learned Public Prosecutor opposed the application submitting that the petitioner who hails from Thirunalvely in Tamil Nadu is an accused in a theft case of the very same Police Station and is also an accused in a case before Chengkotta Police Station in Tamil Nadu. Considering the antecedents of the petitioner and the facts of the present case which show that the accused criminally trespassed into the house in question and caused the death of two persons, I am not inclined to modify the said condition.

This petition is accordingly dismissed.
