Petitioner, a lady, who is the sole accused in C.R.No.41 of 2006 of Thiruvananthapuram Excise Range for an offence punishable under Section 8(2) of the Kerala Abkari Act and whose case is pending before the J.F.C.M-II, Neyyatinkara as C.P.No.101/2007 seeks a direction to the said Magistrate to consider her bail application on the date of her surrender itself before that Court.
Accordingly, this Criminal Miscellaneous Case is disposed of permitting the petitioner to surrender before the learned Magistrate and file an application for regular bail within a period of two weeks from today. In case the petitioner complies with the

above condition, her bail application shall be considered and disposed of on merits preferably on the same date, on which the petition is filed after considering the explanation, if any, offered by the petitioner for her previous non- appearance.
