This is a petition to issue a direction to the J.F.C.M. -I, Kottarakkara to release accused Nos. 1 to 3 in Crime No. 603 of 2007 of Kottarakkara Police Station registered for an offence punishable under Sec. 420 read with Sec. 34 I.P.C. by accepting Annexure -III to V residential certificates and in compliance of the directions contained in Annexure - II order dated 1-12-2007 of this Court in Crl.M.C. No. 3539 of 2007. Going by the report dated 2-1-2008 of the J.F.C.M. I, Kottarakkara, the affidavits filed by A1 and A3 have been accepted.

The learned counsel for the petitioner submitted that A1 and A3 have since been granted bail. With regard to A2, the report of the Magistrate says that A2 did not produce any permanent residence certificate or affidavit stating that he is having no permanent place of residence when the case was posted to 27-122007 and that the case stands adjourned to 29-12-2007. Eventhough the direction was to produce either of the above two, there was no representation on behalf of the 2^nd respondent and the

If A2 has produced any permanent residence certificate or an affidavit showing that he is having no permanent place of residence, the Magistrate shall grant bail to the 2^nd accused on appropriate conditions.
