Petitioner, who is the first accused in Crime no.314 of 2006 of Palode Police Station for offences punishable under Section 304 read with Section 34 I.P.C. and Sections 139 and 140 of the Indian Electricity Act, 2003, seeks anticipatory bail.

One Soman Nadar was found dead by electrocution on 23.10.2006 and the petitioner and the second accused are stated to be responsible for his death, on account of the accidental contact with a live wire allegedly drawn by A1 and A2 for trapping the pigs in that locality.

The learned Public Prosecutor opposed the application.

Anticipatory bail cannot be granted in a case of this nature.

There is no reason why the petitioner should not surrender before the Magistrate concerned and seek regular bail. Accordingly, if the

petitioner surrenders before the Magistrate and files an application for regular bail within two weeks from today, the same shall be considered and disposed of preferably on the same day on which it is filed.
