Petitioner who is the first accused in

F.No.DRI/CHN/VIII/10/36/06 for offences punishable under

section 132 and 135 of the Customs Act, seeks anticipatory bail.

The petitioner is alleged to have been indulging in large scale customs duty evasion and evasion of income-tax and sales tax and also offences under the FEMA.

Heard both sides. After considering the rival

contentions, I am not inclined to grant anticipatory bail to the petitioner. At the same time, as agreed to by the counsel for the petitioner, the petitioner will surrender before the Additional Director, DRI, Palarivattom, Cochin on 11.12.2006 at 10 AM for the purpose of interrogation and recording the statement which process should be according to law and without resorting to any violence or use of force. Thereafter the petitioner shall be produced before the Magistrate concerned before whom the petitioner will be entitled to seek bail by filing
