In this petition, petitioners seek the following reliefs:

“(i) Call for the entire records related to Ex.No.1575/2024 (Annexure – A) from the Court of XLII Additional City Civil & Sessions Judge (CCH-43) at Bengaluru.

(ii) And set aside the execution proceedings in Ex.No.1575/2024 (Annexure – A) filed by the respondent on 19.07.2024 pending at XLII Additional City Civil & Sessions Judge (CCH-43) at Bengaluru.

(iii) To pass any other appropriate order/s deemed fit to grant in the facts and circumstances of the case in the interest of justice and equity.”

After arguing the matter for sometime, learned counsel for the petitioners submits that the petition may be disposed of as withdrawn by directing the Executing Court before whom Ex.No.1575/2024 is pending, to consider the rival contentions and pass appropriate orders in accordance with law.
