In this petition, the petitioner seeks the following reliefs:

“(A) Issue a writ of Certiorari to quash continuation of the entire proceeding in the FDP No.19/2023 before the 2^nd Addl. Senior Civil Judge and JMFC at Tumkuru filed by the respondent No.1. The copy of the order sheet of the FDP No.19/2023 which is produced as ANNEXURE-A;

(b) Grant such other relief/s as this Hon’ble Court may deem fit and proper in the facts and circumstances of the case, in the interest of justice.”

Heard learned counsel for the petitioner and learned

counsel for the respondent and perused the material on record.

After arguing the matter for sometime, learned counsel for the petitioner submits that the petition may be disposed of as withdrawn reserving liberty in favour of the petitioner to file appropriate interlocutory application, memo along with documents and the Trial Court may be directed to consider the same and pass appropriate orders, in accordance with law.
