In this petition, petitioner seeks for the following reliefs:-

“ a) ISSUE a writ of CERTIORARI or any other writ of like nature setting aside the order dated: 18.09.2025 passed in O.S.No.8638/2014 by the XXX Addl. City Civil and Sessions Judge, Bengaluru (CCH-31) (Annexure-A)

b) ALLOW I.A.No.7/2025 filed by the plaintiffs in O.S. No.8638/2014before the XXX Addl. City Civil and Sessions Judge, Bengaluru (CCH-31) (Annexure-G)

c) PASS such other orders or directions as this Hon’ble Court deems fit in the facts and circumstances of the case and in the interest of justice and equity.”

Heard learned Senior counsel for the petitioner and learned counsel for the caveator / 1^st respondent and perused the material on record.

A perusal of the material on record will indicate that the petitioner is aggrieved by the impugned order dated 18.09.2025, whereby the application I.A.No.VII/25 filed by the plaintiffs under Order 16 Rule 6 was dismissed by the trial court.

Learned Senior counsel for the petitioner submits that if the respondent – 1^st defendant were to confirm that the following email IDs are the official email IDs of the wife of 1^st defendant, the present petition may be disposed of without interfering with the impugned order.

The details of the email IDs of Smt.Prema Palangappa wife of 1^st defendant are as under;

Per contra, learned counsel for the 1^st respondent would confirm that the aforesaid email IDs in fact belong to Smt.Prema Palangappa wife of 1^st defendant.

In view of the aforesaid facts and circumstances and in the light of the undisputed fact that the aforesaid email IDs are that of Smt.Prema Palangappa wife of 1^st defendant, the question of interfering with the impugned order would not arise in the facts and circumstances of the instant case.
