Petitioners – accused Nos.1 and 2 in C.C.No.4119/2018 (arising out of Crime No.261/2017), pending before the II Additional Chief Judicial Magistrate Court, Bengaluru Rural District, Bengaluru, for the offences under Sections 323, 324, 504, 506 r/w. 34 of the IPC, are before this Court seeking permission to compound the offences.

No.2 would in unison submit that the parties to the lis have entered into settlement amongst themselves by drawing up certain terms and conditions and seek permission to compound the offences. They have filed a joint compromise petition and separate affidavits of the parties along with a memo before this Court to that effect.

The joint compromise petition reads as follows:

“JOINT COMPROMISE PETITION FILED BY THE PETITIONER AND RESPONDENT NO.2.

The Petitioners and the 2^nd Respondent respectfully submit as follows:

The above Criminal Petition is filed seeking quashing of the proceedings in C.C. No. 4119/2018 pending on the file of the Hon'ble II Additional Chief Judicial Magistrate, Bengaluru Rural District, arising out of Crime No. 261/2017 of Kumbalagodu Police Station, registered for the offences punishable under Sections 323, 324, 504, 506 read with Section 34 of the Indian Penal Code.

The dispute between the Petitioners and the 2nd Respondent arose out of a misunderstanding and a sudden quarrel between neighbours on 20.10.2017. The incident was purely personal in nature and did not involve any issue affecting public peace or public Interest.

During the pendency of the proceedings, the parties, with the intervention of elders, relatives, and well-wishers, have amicably settled all their disputes and differences.

The Petitioners and the 2nd Respondent submit that they are residing in the same locality and have restored cordial and peaceful relations. They have decided to live

harmoniously in future and maintain peace in the neighbourhood.

The compromise has been entered into voluntarily, out of free will and consent, without any force, coercion, undue influence, threat, or pressure from any person whatsoever.

The 2nd Respondent/Complainant states that he has no grievance whatsoever against the Petitioners and has no objection for quashing the criminal proceedings pending against them in C.C. No. 4119/2018.

The parties submit that in view of the settlement arrived at between them, continuation of the criminal proceedings would serve no useful purpose and would only result in unnecessary hardship and wastage of valuable judicial time.

The parties respectfully submit that the possibility of conviction is remote and bleak in view of the settlement and the willingness of the parties to maintain cordial relations.

The parties therefore jointly pray that this Hon'ble Court may be pleased to record the compromise and quash the proceedings in C.C. No. 4119/2018 pending on the file of the Hon'ble II Additional Chief Judicial Magistrate, Bengaluru Rural District, arising out of Crime No. 261/2017 of Kumbalagodu Police Station, in the interest of justice and equity.

WHEREFORE, the Petitioners and the 2nd Respondent most respectfully pray that this Hon'ble Court be pleased to Record the compromise entered into between the Petitioners and the 2nd Respondent, allow the Criminal Petition and quash the proceedings in C.C. No. 4119/2018 pending on the file of the Hon'ble II Additional Chief Judicial Magistrate, Bengaluru Rural District, arising out of Crime No. 261/2017 of Kumbalagodu Police Station.”
