This petition is filed by accused No.1 under Section
483 of Bharatiya Nagarik Suraksha Sanhita, 2023 praying to grant bail in Crime No.280/2025 of Puttenahalli Police Station registered for the offences punishable under Sections 103(1), 109, 238, 324(5) read with Section 3(5) of Bharatiya Nyaya Sanhita, 2023.

contend that earlier a case has been registered in Crime No.102/2025 of Jayaprakash Nagar Traffic Police Station for the offences punishable under Sections 281, 125(a), 106(1) of Bharatiya Nyaya Sanhita, 2023 and Section 134(a and b) of Motor Vehicles Act, 1988. Subsequently, on the complaint of one Nagaraju, a case has been registered against unknown car driver and another in Crime No.280/2025 for the offences punishable under Sections 103(1), 109, 238, 324(5) and Section 3(5) of Bharatiya Nyaya Sanhita, 2023. The incident has taken place in a sudden quarrel. There was no any intention, preparation or ill-will by the petitioner against the deceased and injured. The petitioner and the deceased were not known to each other. Therefore, the offence punishable under Section 103(1) of the BNS, 2023 is not attracted. The petitioner is a sportsman, who has secured several medals and certificates. The major portion of the investigation is over. The petitioner is not having any

criminal antecedents. With this, he prayed to allow the petition.
Pleader for the respondent/State would contend that the offence alleged against the petitioner is a heinous offence punishable with death or imprisonment for life, arising out of a small quarrel relating to the deceased and the injured allegedly dashing the petitioner’s car and causing damage to the mirror. The petitioner chased the bike of deceased and injured and dashed to the said bike. As a result, the deceased succumbed to the injuries and Varun sustained injuries. The said conduct of the petitioner is harsh, and the alleged act was committed with the intention to cause death and injury. He would submit that the incident was not on the spur of the moment, as the petitioner had turned back his car and chased the deceased up to J.P. Nagar. The investigation is in progress.
