This petition is filed by the petitioner -accused No.5 under Section 439 of Cr.P.C/Section 483 of BNSS praying

to grant bail in S.C.No.509/2020 arising out of Crime No.685/2016 of HSR Layout Police Station pending on the file of LXI Additional City Civil and Sessions Judge, Bangalore (CCH-62) registered for offences punishable under Section 397 of IPC.

Heard learned counsel for the petitioner and learned High Court Government Pleader for the respondent –State.

The petitioner had been granted bail earlier on 03.02.2022 and has been released on 15.02.2022. The petitioner remained absent from 04.05.2022 and he has been secured by executing the NBW issued against him on 28.08.2024 and since he is in judicial custody. It is

submitted that the petitioner was suffering from the jaundice and therefore, he could not appear in the case. Now, the petitioner has deposited Rs.50,000/in S.C.No.509/202 on 22.01.2026 towards forfeited bond amount of Rs.1,00,000/-. The petitioner has undertaken to appear before the trial Court on all dates hearing and abide by any conditions to be imposed by this Court. Considering the above aspects, the petitioner has made out case for grant of bail with conditions.
