Court of XXVIII Addl. City Civil and Sessions Court, Mayo Hall, Bengaluru, arising out of Crime No.118/2021 registered by Commercial Street Police Station, Bengaluru, for the offence punishable under Section 397 of IPC, is before this Court under Section 439 of Cr.P.C. seeking regular bail.

Heard the learned counsel for the parties.

FIR in Crime No.118/2021 was registered by Commercial Street Police Station, Bengaluru, initially for the offence punishable under Section 394 of IPC against unknown three persons. During the course of investigation, petitioner herein

was arrested on 11.08.2021 and after completing investigation, charge sheet has been filed against accused persons and the

case is committed to the jurisdictional Sessions Court and is now pending in SC No.1489/2021. Bail application filed by the petitioner before the Trial Court in SC No.1489/2021 was rejected on 11.03.2024. Therefore, he is before this Court.

The material on record would go to show that petitioner is a person with criminal antecedents. Learned HCGP has produced a list of criminal cases registered against the petitioner and perusal of the same would go to show that as against petitioner, 24 criminal cases have been registered in various Police Stations in Bengaluru almost for similar offences. Insofar as present case is concerned, it is brought to the notice of this Court by learned HCGP that prosecution has already closed its side of evidence and the case is now at the stage of recording the statement of accused under Section 313 of Cr.P.C. Learned counsel for the petitioner has failed to produce any material to show that in other criminal cases which are registered against him, he has been enlarged on bail. Considering the aforesaid aspects of the matter, more so the criminal antecedents of the petitioner, since the case before the Trial Court is at the fag end of the trial, it is not a fit case to
