This petition under Section 438 of Cr.P.C, is filed by accused No.1 with a prayer to grant anticipatory bail in Crime No.7/2015 registered by Basaveshwara Nagar Police Station, Bengaluru City for the offence punishable under Section 392 of IPC.

Heard the learned counsel appearing for the

parties.

Learned HCGP has raised an objection with regard to maintainability of the petition on the ground that, the petitioner, who was earlier arrested in the present case was enlarged on regular bail. Therefore, his prayer for grant of anticipatory bail cannot be maintained.

Learned counsel for the petitioner submits that the petition may be dismissed as not pressed with liberty to the petitioner to surrender before the jurisdictional Court and file necessary application to recall the NBW issued against him/ to seek regular bail.
