Accused No.1 in S.C.No.5019/2022 pending before the Court of IV Additional District and Sessions Judge, Tumakuru, Sitting at Madhugiri, arising out of Crime No.40/2022 registered by Koratagere Police Station, Tumakuru, for offences punishable under Sections 302, 201 read with Section 34 of IPC is before this Court in this successive bail application filed under Section 439 of Cr.PC seeking regular bail.

Petitioner had earlier approached this Court in Crl.P.No.2865/2023 which was disposed of by the co-ordinate Bench of this Court by order dated 07.06.2023, reserving liberty to the petitioner to file a fresh petition before the Sessions Court after examination of C.W-1 is completed before the trial Court.

Material produced before this Court would go to show that C.W-1 has been examined before the trial Court. However, no fresh petition has been filed by the petitioner before the Jurisdictional Sessions Court, though liberty has been granted to him by this Court in Crl.P.No.2865/2023.

Therefore, this petition is disposed of with liberty to the petitioner to file a fresh petition before the Sessions Court and in the event petitioner files such bail application before the Sessions Court, the same shall be considered on merits and disposed of as expeditiously as
