THIS WRIT PETITION IS FILED UNDER ARTICLE 226 AND 227 OF THE CONSTITUTION OF INDIA, PRAYING TO DIRECTING THE R2 TO CONSIDER THE REPRESENTATION LETTER DATED 19/01/2024 GIVEN BY THE PETITIONER TO R2 WHICH IS AT ANNEXURE-H AND TO ISSUE LETTER OF INTENT TO THE PETITIONER WITH RESPECT TO THE BELOW DETAILED TENDER, WHICH IS AT ANNEXURE-C. THE FRESH TENDER (PACKAGE TENDER) BEARING TENDER REFERENCE NO. BMCRI/SEC-CLNG/18/2023-24 DATED 19/09/2023, BEARING E-PROCUREMENT REFERENCE NO. BMCRI/2023-24/SE0001, CALLED OUT VIDE TENDER NOTIFICATION DATED 21/09/2023, FOR PROVIDING SECURITY SERVICES TO B.M.C.R.I. AND TO THE VARIOUS DEPARTMENTS OR WINGS OF B.M.C.R.I. SUCH AS MINTO EYE HOSPITAL, VANI VILASA HOSPITAL, VICTORIA HOSPITAL, B.M.R.C.I. HOSTEL, (ITEM NO. 1 TO 5) & ETC.

THIS PETITION, COMING ON FOR FRESH MATTERS LIST, THIS DAY, THE COURT MADE THE FOLLOWING:

ORDER

The petitioner is before this Court seeking the following

prayers:

"1. Issue a Writ of mandamus or any other writ directing the Respondent No.2 to consider the Representation letter dated 19.01.2024 given by the petitioner to Respondent No.2 which is at Annexure-H and to issue letter of Intent to the petitioner with respect to the below detailed Tender, which is at Annexure-C:

The fresh tender (Package Tender) bearing Tender Reference No.BMCRI/SEC-CLNG/18/2023-24 dated 19.09.2023, bearing E-procurement Reference No.BMCRI/2023-24/SE0001, called out vide tender notification dated 21.09.2023, for providing Security services to B.M.C.R.I. and to the various departments or wings of B.M.C.R.I. such as MINTO Eye Hospital, Vani Vilasa Hospital, Victoria Hospital, B.M.R.C.I. Hostel, (Item No.1 to 5):

C) Item No.3 (Item Code BMCRI2023003):

For providing Manpower Services of Security Service at Victoria Hospital, Bengaluru, on outsourced basis.

D) Item No.4 (Item Code BMCRI2023002):

For providing Manpower Services of Security Service at BMCRI Hostel, Bengaluru, on outsourced basis.

E) Item No.5 (Item Code BMCRI2023001):

For providing Manpower Services of Security Service at BMCRI College and Hospital, Bengaluru, on outsourced basis And.

2. Issue a Writ of mandamus or any other writ directing the Respondent No.2 to award the above detailed Tender, which is at Annexure-C, immediately to the petitioner by issuing work order to the Petitioner, without making any further delay And

3. Issue a Writ of mandamus or any other writ directing the Respondent No.2 to complete all the above remaining procedures of the above detailed Tender which is at Annexure-C, at the earliest within a week, by allowing this petition And

4. Issue a Writ or any other nature of Writ or order or direction and grant such other relief in favour of the Petitioner as deem fit in the circumstances of the case in the ends of justice and equity."

This Court on 13.02.2024 had passed the following

"Petitioner to serve on any panel counsel representing the respondents and file an acknowledgment to that effect.

The respondents to explain as to what has become of the tender, pursuant to which, the petitioner is said to be the lowest bidder and, as to why the tender has not taken to its logical conclusion, despite passage of 8 months.

Tag this petition along with W.P.No.2294 of 2024 and list the matter on 11.03.2024."

Again on 21.02.2024, this Court had passed the

following order:

"The petitioner is directed to serve on any panel counsel representing the respondent No.1/Bangalore Medical College and Research Institute (B.M.C.R.I.) and file an acknowledgment of such service before the Court in the next three days.

If service is completed, put up the matter on 29.02.2024 in the fresh matters list."

Sri Basavaraj, learned counsel for the respondents submits that the work order is issued to the petitioner on 04.03.2024.

In the light of the work order being issued, the grievance of the petitioner is thus, addressed. The petition is disposed as having become unnecessary.
