appearance and deposed that he had a consent for granting of occupancy right in respect of the petitioner-J. Vijendra Nayak. The respondent No.5-Mutt (landlord) was placed ex-parte. The respondent-Land Tribunal, after considering the material on record, by its order dated 27th December, 1980, conferred occupancy right for entire extent of 25 cents each in two bits in Survey No.158 of Shivalli Village. In furtherance of the same, Form No.10 has been issued by the competent Revenue Authority as per Annexure-L, which concludes the issuance of occupancy right. It is also pertinent to mention here that the land in question has been converted for Non-Agricultural purpose by the petitioner-J. Vijendra Nayak as per Annexures 'M' and N' respectively. In that view of the matter, I find force in the submission made by learned counsel Sri. Sampat Anand Shetty appearing for the petitioner-J. Vijendra Nayak in Writ Petition No.25781 of 2012 that the order dated 21st April, 1977 is one which has been created to defeat the right of the petitioner-J. Vijendra Nayak. It is also evident from Annexure-A order of the respondent-Land Tribunal dated 21st April, 1977 that the Members of Land Tribunal have not signed the said order and that apart, the said order has not find place in the
