Sri.Santhosh Kumar.M.B., learned counsel for the petitioner and Smt.H.R.Renuka., learned counsel for the respondents have appeared in person.

The petitioner has sought for a Writ of Certiorari to quash the order dated:05.07.2023 in ¸ÀASÉ: PÀgÁ¸Á/PÉÃPÀ/¸ÀA/¹§âA¢/D.ªÀUÁð/ 1266/23-24 passed by the first respondent vide Annexure-F.

Learned counsel for the petitioner and the respondent have urged several contentions. Heard, the contentions urged on behalf of the respective parties and perused the Writ papers with utmost care.

Learned Counsel Smt.H.R.Renuka., on instructions submits that the Corporation has withdrawn the transfer order dated:05.07.2023 with a condition that the petitioner should not press prayer No.(b) & (c) and he shall discharge his duties on Honnali Depot without resistance as per Annexure - A dated:12.11.2021. Learned counsel submits a memo has been filed by furnishing the copy of a letter dated:02.11.2023 addressed by the Chief Law Officer to counsel on record stating that the Competent Authority has accorded approval to withdraw the transfer order dated 05.07.2023. Hence, counsel submits the memo may be place on record and appropriate order may be passed.

Learned counsel Sri.Santhosh Kumar.M.B., submits that the petitioner has no objection and he shall not press prayer No.(b) & (c).
